Terms & Conditions
1. Service Delivery
1.1 Acre Insight will use commercially reasonable efforts to provide data center siting assessment services (“Services”) in accordance with industry standards. During onboarding, you will receive a survey to fill out containing site data.
1.2 By accessing or using our website and Services, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access our website or use our Services.
2. Restrictions and Obligations
2.1 You agree not to:
- Reverse engineer, decompile, and disassemble our proprietary assessment algorithms or software
- Use our Services for unauthorized commercial resale or third-party benefit
- Export assessment reports in violation of U.S. export control laws (EAR, OFAC)
- Interfere with or disrupt our Services or servers
2.2 You are responsible for:
- Confidentiality of survey address and your information
- Ensuring accurate property data submissions
- Complying with all zoning/environmental laws related to submitted properties
- Using our Services only for lawful purposes
3. Confidentiality & Data Rights
3.1 Both parties agree to protect proprietary information exchanged during assessments, including:
- Acre Insight’s evaluation algorithm and market models
- Client-submitted property specifications and business plans
3.2 You retain ownership of all submitted property data. Acre Insight retains rights to:
- Analytical methodologies and report templates
- Aggregated/anonymized market insights derived from assessments
3.3 You may share Acre Insight assessment reports, conclusions, or social media provided you:
- Prominently display the Acre Insight logo and copyright notice
- Include the disclaimer: ‘Results represent snapshot analysis and may not reflect current market conditions’
- Do not modify report formatting, methodology descriptions, or key metrics
- The reports or excerpts cannot be published without consent of Acre Insight
Failure to comply may result in content removal requests and/or suspension from Services.
4. Intellectual Property
4.1 The content, features, and functionality of our website and Services, including but not limited to text, graphics, logos, and software, are owned by Acre Insight and are protected by copyright, trademark, and other intellectual property laws.
4.2 Use of Our Intellectual Property
Except as previously permitted in section 3.3, you may not reproduce, distribute, modify, create derivative work of, publicly display, publicly reform, republish, download, store, or transmit any of our intellectual property without our express written consent.
4.3 Your Intellectual Property
You retain all rights to any content you submit, post, or display on or through our Services. By submitting, posting, or displaying content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, adapt, publish, and distribute such content.
5. Payment Terms
5.1 Confirmation of processed order is provided upon completion via Stripe and their accepted payments.
6. Term and Termination
6.1 Service agreements remain effective until:
- Completion of purchased assessments
- Mutual written termination
- Breach of terms (with 30-day cure period)
6.2 Upon termination:
- All unpaid fees become immediately due
- Access to assessments is revoked
- Confidentiality obligations persist for 7 years
7. Communications
7.1 By using our Services, you consent to receive:
- Notification of service updates
- Occasional marketing communications
7.2 You may opt out of marketing communications via links in emails.
8. Liability Framework
8.1 To the fullest extent permitted by applicable law, Acre Insight shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use goodwill, or other intangible losses resulting from:
- Any unauthorized access to or use of our servers and/or any personal information stored therein
- Your use or inability to use our Services
- Any interruption or cessation of transmission to or from our Services
8.2 We are not liable for:
- Third-party infrastructure failures (e.g., power grid data sources)
- Changes in zoning/regulatory environments post-assessment
9. Indemnification
9.1 You agree to defend and indemnify us against claims arising from:
- Unauthorized sharing of assessment reports
- Misrepresentation of property details
- Violation of export control laws
10. Disclaimer of Warranties
10.1 The Services provided by Acre Insight are offered on an “as-is” and “as-available” basis. We expressly disclaim all warranties of any kind, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
10.2 Acre Insight does not warrant that the Services will meet your specific requirements, be uninterrupted, timely, secure, or error-free. We make no warranty regarding the quality, accuracy, timeliness, truthfulness, completeness, or reliability of any content or information provided through the Services.
10.3 While we strive for accuracy, Acre Insight does not guarantee the accuracy, completeness, or usefulness of any information on the Services and will not be responsible for any errors or omissions in the content.
10.4 Any third-party services or software integrated into our Services are provided “as is” and we disclaim any liability for their performance, accuracy, or compatibility with our Services.
10.5 Acre Insight is not liable for any damages or losses resulting from any interruption, suspension, or termination of the Services, including but not limited to direct, indirect, incidental, punitive, and consequential damages.
10.6 Any reliance you place on our Services for making business decisions is strictly at your own risk. Acre Insight shall not be liable for any losses or damages arising from your use of the Services for business decision-making purposes.
10.7 To the maximum extent permitted by law, in no event shall Acre Insight, its employees, partners, agents, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Services.
11. Changes to Terms
11.1 We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days’ notice prior to any terms taking effect. What constitutes a material change will be determined at our sole discretion.
11.2 Material changes may include, but are not limited to, alterations to our service offerings, pricing structure, data handling practices, or user rights and responsibilities. Minor changes, such as typographical corrections or clarifications, will not typically be considered material.
12. Dispute Resolution
12.1 In the event of any dispute arising out of or relating to these Terms, including their formation, interpretation, or alleged breach, the parties agree to the first attempt to resolve the dispute through good-faith negotiations. Disputes must be submitted in writing within 14 days of the invoice date. If the dispute cannot be resolved through negotiation within 30 days, both parties agree to submit to binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in the United States, and the language of the arbitration shall be English. The decision of the arbitrator shall be final for both parties.
13. Severability Clause
13.1 If any of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.
14. Assignment Clause
14.1 Acre Insight may assign or transfer these Terms, in whole or in part, without restriction. You may not assign or transfer any rights or obligations under these Terms without Acre Insight’s prior written consent.
15. Miscellaneous
15.1 Governing Law: These Terms shall be governed by and construed in accordance wth the laws of the State of Delaware, without regard to its conflict of law principles. Any disputes arising under or in connection with these Terms shall be resolved exclusively in the courts located in Delaware.
15.2 Force Majeure: Not liable for delays caused by natural disasters, pandemics, or utility outages.
16. Entire Agreement Clause
16.1 These Terms, including any legal notices and disclaimers contained on this website, constitute the entire agreement between you and Acre Insight regarding your use of the Service, and supersede all prior agreements and understandings, whether written or oral, regarding such subject matter.

Refund and Cancellation Policy
Acre Insight strives to provide high-quality data center siting assessment services. However, we understand that circumstances may arise where a refund or cancellation is necessary. Our policy is as follows:
- Cancellation before the assessment begins: If you cancel your order before we begin the assessment process, you will receive a 50% refund of your payment.
- Cancellation during assessment: Once the assessment has begun, refunds will be prorated from the 50% that is refundable after work begins. A cancellation fee may apply to cover administrative costs.
- Completed assessments: Due to the nature of our service, which provides valuable intellectual property and market insights, we do not offer refunds for completed assessments.
- Expedited services: The additional fee for expedited services is non-refundable once the expedited process has begun.
- Bulk order cancellations: For bulk orders (2 or more sites), cancellation policies will be applied on a per-site basis.
- Timeframe for refunds: Approved refunds will be processed within 10 business days of the cancellation request
- Quality guarantee: If you believe our assessment does not meet the standards outlined in our service description, please contact us within 5 business days of receiving your report. We will review your concern and may offer a reassessment or partial refund at our discretion.
- Method of refund: Refunds will be issued using the same method of payment used for the original transaction, unless otherwise agreed upon.
- Non-refundable fees: Any third-party fees or charges incurred by Acre Insight in the process of providing our services (e.g., data acquisition costs) may be non-refundable
- Cancellation request process: To request a cancellation or refund, please contact our customer support team via email at hello@acreinsight.com. Please include your order number and reason for cancellation in your request.
- Data retention after cancellation: In case of cancellation, we will retain your data, as outlined in our Privacy Policy. Personal data related to your order will be securely stored or deleted in accordance with applicable laws.
- Force Majeure: In the event that Acre Insight is unable to fulfill an assessment due to circumstances beyond our control (such as natural disasters, acts of war, or significant changes in regulations), we reserve the right to cancel the order and provide a full refund, or to postpone the assessment with the client’s agreement.
- Delivery Delays: In the event that we are unable to meet our delivery deadline, we will promptly notify you and work towards a mutually agreeable resolution.
- Dispute Resolution: In the event of a dispute regarding a refund or cancellation, both parties agree to first attempt to resolve the issue through good-faith negotiations. If a resolution cannot be reached, the dispute will be handled as per the Dispute Resolution clause in our Terms and Conditions.
- Liability for canceled services: Our liability for canceled or refunded services is outlined in Section 8 of our Terms and Conditions. Acre Insight is not responsible for any indirect, consequential, or incidental damages resulting from cancellations or refunds.
- Changes to this Policy: We reserve the right to modify this Refund and Cancellation Policy at any time. Changes will be effective immediately upon posting on our website. It is your responsibility to review this policy periodically for changes.
All requests will be reviewed on a case-by-case basis. Acre Insight reserves the right to make exceptions to this policy at its sole discretion.
Please note that this refund and cancellation policy does not affect any rights you may have under applicable consumer protection laws.
